Aggravating Factors for DUI Charges in P.G. County

There are a few different factors that can lead to enhanced penalties in Prince George’s County. One such factor that is very important is BAC level. If you are between a 0.08% and a 0.15% you are generally considered to be on the lower end of the spectrum, however as you continue past a 0.15% it becomes a much more serious offense. That percentage of alcohol in your system is something that can absolutely resonate with how these cases are handled.

These numbers are very important which is why when submitting to the test, you really have to understand how seriously this matter is going to be taken. If your BAC is substantially over a .2% then you’re going to have a lot of explaining to do and will likely be required to seek a fair amount of treatment.

When Minors are in the Vehicle

If a minor is in a vehicle, there’s a penalty enhancement. Most of the time you see the same two types of DUI charges under the Transportation Article – TA. 21. 902 A1 or A2. However, there is a third type of charge that is not seen that often under A3 if a minor is in the vehicle, and it’s an immediate penalty enhancer. Even worse is when a judge hears that there was a minor in the vehicle, they’re going to send a clear message by enhancing that penalty as much as they can in your case.

To a Judge, someone who was acting in such a reckless way by drinking and driving as to not only endanger the greater public but that you cared so little that you now endangered your child or someone else’s child is asking to be punished. That is a major, major factor in all DUI cases, Judge’s are always interest to know  who was in that car and in face if you’re alone in the vehicle, you’re treated a little bit better in the eyes of the justice system.
