Maryland Gun Laws

If you are in the state of Maryland and you want to obtain a handgun permit, you have to be at least 21 years of age and you have to complete a firearm safety training course. After that, you also must prove that you have not been convicted of any crime that would disqualify you from owning a gun, that you’re not a fugitive, that you’re not a drunk, that you’re not an addict of a controlled substance, that you have not spent more than 30 consecutive days at a mental institution or have been diagnosed of a mental disorder, and that you do not have a protective order against you.

While a protective order is only good for one year, there is a stipulation that the person must surrender all guns to Maryland State Police. Everything has to be done properly. You would fill out an application with the police or the sheriff in the county where you live. That’s the most prudent way to go about this process, because while you’re there, you’ll take a safety training course and they will explain the rules regarding what you can and cannot do. If you have questions about guns, you can call Maryland State Police and ask to speak with someone about the rules. One of the best things to do is to refer to the Maryland State Police website and look at gun laws, or call a Maryland gun attorney. We know the law and we can advise you as to what you should or should not do and what you can or cannot own.

Laws Regarding Guns in Vehicles

The laws regarding storing weapons in vehicles are complex and can depend on the circumstances of the case, including whether you have a license for the weapon, whether it is a restricted weapon, and whether you have been convicted of a felony. However, there are some general tips to keep in mind.

The most important thing to remember is to have the ammunition stored separately from the gun. If you are familiar with the gun and have the ability to take it apart and store it properly, then we don’t have to worry about what was found because it was not in working order.

It can’t be assumed at that point that you were carrying it with the intent to commit a crime. Many situations come down to officer safety. They look at what the circumstances of the stop are, whether you have a proper carrying box, whether the gun is in pieces, and whether there is ammunition.

If you have a license, then you should show that to the officer so that they know you are allowed to carry that weapon. You would also want to explain to them that you were on your way to or from the firing range, a gun collector, or somewhere that makes sense for having a gun.

Issues of Gun Possession During Traffic Stops

Maryland Gun Laws.It is very important that the gun be in pieces. In Maryland, wearing, carrying, or transporting a handgun is prohibited and there is a presumption if you are traveling with it that you are doing it knowingly. The term “handguns” could refer to pistols, revolvers, and firearms that are able to be concealed. Concealment is a little bit different in regards to a shotgun or short barrel rifle because those are more visible; they cannot be concealed under the seat of a vehicle.
